Terms of Use

These Terms of Use apply uniformly to the Barnaby app (iOS and Android) and the website barnaby.at. They govern the relationship between you and the operator of Barnaby — deliberately in clear, simple language.
Barnaby is a free app for recording dog walks with community features. By registering, you agree to these terms.
1. Contracting party and scope
Your contracting party is Felix Klieber, Blumengasse 76, 1170 Vienna, Austria (hereinafter “we” or “operator”). Contact: info@barnaby.at, support: support@barnaby.at.
These terms apply to the use of the Barnaby app (iOS and Android) and the website barnaby.at by natural persons with a personal account.
For the licence to the app copy from the Apple App Store, Apple’s standard end user licence agreement (Licensed Application End User License Agreement) applies in addition; the Barnaby service itself is governed exclusively by these Terms of Use.
2. Description of the service
Barnaby is free of charge and includes in particular: GPS recording of walks, dog profiles, a photo feed with comments and wuffs, follower features, statistics and achievements, and push notifications. A weekly recap by e-mail (unsubscribable at any time) is prepared but is not being sent at this time (see Privacy Policy, section 10).
Dog profiles can be managed jointly with other users (dog sharing): anyone who has a dog's secret join code or QR code joins the dog profile immediately and sees its data and walks. Therefore only share the code with people you trust; existing owners are informed about joins, and owners with an admin role can manage and remove members.
GPS accuracy depends on your device, the operating system and the environment; routes and measurements may be inaccurate.
Barnaby is not a safety or tracking system and is not suitable for locating, monitoring or protecting animals or people. Do not rely on the app for such purposes.
Statistics and health tips in the app are rule-based estimates and do not replace veterinary advice. For health questions about your dog, please consult a vet.
We provide the service within the bounds of what is technically reasonable; maintenance windows and temporary restrictions are possible.
3. Registration and minimum age
Use is permitted for persons aged 16 and over. Registration is not possible under the age of 16.
One account per person is intended. Your registration details must be accurate; keep your credentials secret.
The user agreement is concluded upon completion of registration. These terms are available at any time in the app and on barnaby.at.
4. Free of charge and data
Using Barnaby is free of charge. We process your personal data solely to provide the service and to comply with legal obligations — details are set out in the privacy policy (in the app and on barnaby.at).
These Terms of Use contain no data protection consents; all information about data processing can be found exclusively in the privacy policy.
5. Right of withdrawal
Insofar as a right of withdrawal exists under the Austrian Distance and Off-Premises Transactions Act (FAGG), you may withdraw from the contract within 14 days of registration without giving reasons.
The withdrawal is not bound to any form — an e-mail to info@barnaby.at or deleting your account in the app (Settings → Manage account → Delete account) is sufficient, for example. You may also use the model withdrawal form in the annex to these terms; this is not mandatory.
The right of withdrawal expires early in accordance with § 18 FAGG.
Since use is free of charge, a withdrawal does not cost you anything and there are no payments to be refunded.
6. Right to use the app
We grant you a non-exclusive, non-transferable right to use the app for private purposes.
Not permitted are, in particular, circumventing technical protection measures and automated use of the service outside the app. Your mandatory statutory rights (e.g. §§ 40d, 40e of the Austrian Copyright Act) remain unaffected.
7. Your content and licence
You retain all rights to the content you upload (e.g. photos, comments, profile details, routes).
So that we can display your content, you grant us a non-exclusive, free-of-charge licence limited to operating and displaying the app’s features (e.g. storing, technical conversion, display in the feed to the recipients you choose).
For advertising or marketing — such as featuring your post on Barnaby's own social media channels — we only use your content if you have given prior, separate and voluntary consent to the specific use (details in section 7 of the privacy policy). This consent is not a prerequisite for using the app and can be revoked at any time with effect for the future.
This licence ends when you delete the content or your account. Comments are an exception: upon account deletion they remain in anonymised form (without any link to your person, shown as “Deleted user”); the licence continues for them. For technical reasons, copies in backups and individual residual technical data may remain for up to 30 days; if we have to restore a backup, we remove content deleted in the meantime again without delay (details in the privacy policy, section 17).
You warrant that you are entitled to publish your content and that you do not infringe third-party rights (e.g. copyright and personality rights, identifiable persons in photos).
8. Rules of conduct and prohibited content
Barnaby is meant to be a friendly place. There is zero tolerance for objectionable content and abusive behaviour. Prohibited are in particular:
- unlawful, insulting, violence-glorifying, pornographic or discriminatory content,
- depictions of animal cruelty or calls for it,
- harassment, threats or stalking of other persons,
- publishing other people’s personal data or locations without consent (doxxing),
- spam, misleading content and commercial advertising without our consent,
- impersonating another person or organisation,
- automated access, bots and mass extraction of data (scraping),
- circumventing blocks, visibility or protection measures.
9. Moderation, reporting and blocking
You can report content and users directly in the app or contact us by e-mail at support@barnaby.at. You can block other users at any time.
We review reports manually and carefully, within 24 hours of receipt at the latest; we inform the reporting person of the outcome. As the only automated tool, the app checks a requested username (@handle) against a word list when it is claimed and automatically rejects hate terms and reserved names. Content or accounts are never removed or suspended automatically — we take such decisions manually.
In the event of violations, we act in a graduated and proportionate manner: notice or warning, removal or restriction of the visibility of individual content, temporary suspension, permanent suspension.
Affected users receive a statement of reasons for the decision and can respond to it (counter-statement to support@barnaby.at); we will then review the decision again.
10. Termination and suspension
You can end the agreement at any time without notice by deleting your account in the app (Settings → Manage account → Delete account).
We may discontinue the free service in whole or in part. In that case we will announce this with reasonable notice — usually about two months — in the app or by e-mail, and point you to the data export in the app so you can save your data beforehand.
An extraordinary suspension or termination by us is only permitted in the event of serious violations of section 8 (e.g. unlawful content, harassment, abuse of the service) — with a statement of reasons and the opportunity to respond in accordance with section 9.
11. Changes to these terms and to the service
We may only amend these terms for objective reasons: changes in the law or case law, technical or security-related adjustments, and further development of the service.
For changes to these Terms: we announce them at least one month before they take effect, in the app or by e-mail. In the announcement we will specifically point out that the changes are deemed accepted if you do not object to them before they take effect.
If you object, the previous terms continue to apply to you; in that case we may terminate the agreement ordinarily with reasonable notice in accordance with section 10. Independently of this, you can terminate the agreement free of charge at any time.
Material changes — those that significantly alter the balance between the service and your obligations — only take effect if you actively agree to them.
For changes to the service itself (not these Terms): we continuously develop Barnaby; feature changes are made only for the reasons stated above and to a reasonable extent. We will inform you at least 30 days in advance of any material restrictions, together with the option to terminate the agreement free of charge.
12. Warranty
Your statutory warranty rights remain fully intact. These terms do not limit them.
13. Liability
We are liable without limitation in cases of intent and gross negligence, and for personal injury.
In cases of slight negligence, we are not liable for material damage or financial loss.
Important note on your own responsibility (not an exclusion of liability): pay attention to your surroundings and road traffic while using the app, keep control of your dog, and do not operate the app while driving a vehicle.
14. Dispute resolution
If you have a problem, please contact support@barnaby.at first — most issues can be resolved directly.
The operator is neither obliged nor willing to participate in alternative dispute resolution proceedings before a consumer dispute resolution body (alternative dispute resolution entity). In the event of a dispute, we will inform you, in accordance with § 19 (3) of the Austrian Alternative Dispute Resolution Act (AStG), about the competent dispute resolution body (e.g. Internet Ombudsstelle, ombudsstelle.at).
15. Applicable law
Austrian law applies, excluding its conflict-of-law rules.
If you are a consumer with your habitual residence in another country, you retain the protection of the mandatory consumer protection provisions of that country.
16. Final provisions
Should any provision of these terms be invalid, the remaining provisions remain in effect.
These terms are available in German, English, Spanish and French (Spanish and French only in the app); in case of discrepancies, the German version prevails.
